An application by Crown Counsel to treat one of his witnesses in the Public Works Department Hung Hom Electrical Workshop larceny case as hostile was refused by Mr. J. Wicks at Kowloon yesterday.

Mr. A. Hooton, Crown Counsel, submitted that C. M. Rowe should be treated as hostile as the evidence he tendered before the court was, in some material respect, different from the statement he made to the police.
