APPLICATION REFUSED
An application by Crown Counsel to treat one of his witnesses in the Public Works Department Hung Hom Electrical Workshop larceny case as hostile was refused by Mr. J. Wicks at Kowloon yesterday.
Mr. A. Hooton, Crown Counsel, submitted that C. M. Rowe should be treated as hostile as the evidence he tendered before the court was, in some material respect, different from the statement he made to the police. Quoting from the statement, Mr. Hooton said that Rowe said, "I rang up Mr. Spary asking him if he could put me on to the same man who had executed the previous contract. that he could do so and promised to send the man to me," which was different from what he had said in the box.
