Forwards letter addressed to the Treasury agreeing to the proposal in No. 4 that only the not receipts from the pro- posed Penang telephone system should be assessed to military contribution, and to the extension of the principle new undertakings of a similar nature, each case, however, to be con sidered on its merits.

Sanctions Ordinance 6 of 1899, for- warded in No. 8, and requests him to Inform the Unofficial Members that their protest has been received, and to refer them to No. 3, which should be laid before the Council if this has not already been done.

Agrees that the receipts from the public telephone system to be established in Penang should be assessed at their net and not at their gross amount, and to the application of this principle to new undertakings not different in charac- ter and productiveness from railways: but each case should be considered on its merits by the three Depart- ments concerned.

Informs him in reply to No. 1 that His Majesty's Government agree to con- tribution based on net receipts.

Enquires the exact significance of the phrase "and all other military charges whatsoever" in Clause 5 of the Ordi- nance in No. 9, and suggests inclusion in any further Ordinance which may be enacted of a provision that the increase of contribution should not affect the liability of the Colonial Government to provide, free of charge, any available Colonial military land required for military works.

the Defence Contribution Ordinance providing for the assessment to con- tribution of the net revenue only from productive undertakings such as railways, do, in order to avoid the necessity of an amending Ordinance' for every fresh undertaking, and states that if Treasury concur in the amend- ment the Governor will be instructed that no new undertaking is to be deemed "of a similar character" to railways without previous reference to the Secretary of State; explains that the words referred to in No. 14 were inserted with the concurrence of the War Office.
