TRADING WITH THE ENEMY ORDINANCE, 1914. Order by the Governor

(under section 20 of the Ordinance),

In exercise of the powers conferred hy section 20 of the Trading with the Energy Ordinance, 1914, His Excellency the Governor makes the following Order —

1. This Order may be cited as the Trading with the Enemy Cation (Custodian) (Amendment) (Japan) Order, 1949, and shall come into force on the 22nd day of April, 1949,

2. Section 16 and section 17 of the Trading with the Enemy Exemption Ordinance, 1914, (requiring payment of certain moueya to the from Custodian and imposing restrictions and requirements in regard to necessity to certain property in the Colony of Hong Kong) shall not apply to-

(a) any money which would but for the existence of a state of war become payable to or for the benefit of any person within the description contained in paragraph 3 of this Order on or after the date when this Order comes into force by reason of any trade authorised by paragraph 2 of the Trading with the Enemy (Authorisation) (Japan) Order, 1949;

(5) any property which on or after the date when this Order comes into force comes into the ownership of such person as aforesaid by reason of nay such trade as aforesaid.

3. This Order shall apply to the Japanese state, to any Application individual resident or carrying ou business in Jupan or to any body of Order in of persons (whether corporate or unincorporate) carrying of the Japanese business in or constituted or incorporated in or under the lawe suce, etc. of Japan.

4. For the purposes of this Order "Japan" means all "Japan" territory which was under Japanese sovereignty on 7th December, defined.

EXPLANATORY NOTE,

(This Note is not part of the above Order, but is intended to indicate its general purport.)

By the Trading with the Enemy (Authorisation) (Japan) Order, 1949, the Governor authorised the transaction of the business of insurance with the Japanese state and with persons in Japan. The present Order removes Custodian control over money and property accruing in consequence of this authorisation, (Secretariat File No. 8/5401/47).
