TRADING WITH THE ENEMY ORDINANCE, 1914. Order by the Governor

(under section 20 of the Orilinance).

In exercise of the powers conferred by section 20 of the Trading with the Enemy Ordinance, 1914, His Excellency the Governor makes the following Order-

1. This Order may be cited as the Tending with the Enemy Ciption, (Custodian) (Amendment) (Japan) (No 2) Order, 1949.

2. Section 16 anil section 17 of the Trading with the Enemy Excoption Ordinance, 1914, (requiring payment of certain moneys to the from Custodian and imposing restrictions and requirements in regard to accesity to certain property in the Colony of Hong Kong) shall not apply to Lo Custodian.

(a) any money which would but for the existence of * state of war become payable to or for the benefit of any person within the description contained in paragraph 3 of this Order on or after the date of this Order by reason of any trade authorised by the Trading with the Enemy (Authorization) (Japan) (No. 2) Order, 1949; and

(4) any money or other property which on or after the date of this Order comes into the ownership of any such person aa aforesaid by reason of any such trade as aforesaid.

3. This Order shall apply tom

(a) any Government, Publie or other Authority in Japan; (b) any individual resident in Japan;

(e) as respecte any business carried on in Japan, to any individual or body of persons (whether corporate or unincorporate) carrying on that business.

4. For the purposes of this Order "Japan" means all "Japan" territory which was under Japanese sovereignty on 7th December, defined, 1941.

EXPLANATORY NOTE.

By the Trading with the Enemy (Authorisation) (Japan) (No. 2) Order, 1949, the Governor authorised application for the grant of a patent or the registration of utility model, design or trade mark in Japan and transactions incidental thereto and aubsequent dealings in respect of any such patents grauted or any such utility models, designs or trade marks registered. The present Order removes Custodian control over money and property acerning in consequence of that authorisation. (Secretariat File No. 8/5401/47).
