And if, after these coD- siderations had been duly weighed, I had any dubts left as to what the intention of the com pany really was, they vinish when I come to Ng San Kau's statement: "I understood it to be that we should take 40/9 ths of $95,000" or, as he immediately changed it to "of the value of the ship." 1 regret that I cannot believe this introduction into his thoughts at that time of a matter which it is clear he had never thought of, and which was obviously the result of con- ference with hi· legal advisers.

I am therefore of opinion that by signing the policy the company greed to accept the estimate of value given by the plaintiff, which had requsted him to give, and which they in- seated in the policy.
