"The decision of the preliminary examination

the case is as follows:-

The defendant was engaged as compradore in May 1952 by the Chartered Bank of India, Australia and China, No. 26, Naniwa niachi, Kobe, and while thus employed he committed the following acts: -

1-Between about May 1905 and September

4th of the same year he spent for his own pur poses without the consent or permission of his employers the sum of Y65,734.28, which was placed under his charge.

2.-The defendant "was doing business with a Chinese firm of the style of Fu-Hsing of Hak-Hing with the approval of Mr. John Adamson manager of the bank. Taking traninge of the pronunciation of the trade name (HuHsing or Pok lling) of a friend of his named Yebh” Sha 1-ling, and of the fact that Mr. Adamson did not fead Chinese characters, the defendant conceived a device for defrauding the bank and caused Yéh Shao-ling to draw three bills for Y10,000, Y15,000 and Y20,000 re- spectively in the name of in-Hsing and pre sented the same to Mr. Adamson on August :t, 8th and 12th, 1905, misrepresenting them a bills drawn by the firm of Funsing, and haudulently obtained a sum of Yatt3r.zę for the bills from the bank.
