Three Chiness were charged be foro Mr. T. S. Whyte-Smith at the Kowloon Magistracy yesterday, with possetzion of seditious pro- "paganda calculated to Causo breach of the peace.

Detective Sergeant Donovan pro secuted and Mr. F.. C. E. Rendal appeared for the first defendant..

Six men were originally charged but Sorgeant Donovon said that the prosecution did not wish to bring any evidence against three of them who were accordingly allowed to leave the Court.

Giving evidence, Sergt. Donovan. said that in company with a squad of Chinese detectives he visited the first floor of 145, Woosung Street. He went to the front cubicle and knocked at the door, and announced

that he was a member of the police. Receiving no reply the door was forced and on entering he found the threo defendants sitting on the only bed in the room. They admitted that they lived in the cubicle, and

search was made. Underneath the bed a quantity of books and papers were found on top of a suitcase and a rug. The second, defendant said the suitcase was hia and the rug was owned by third defendant. The printed matter was sent to the S.C.A. for translation, there being over 500 pamphlets.

Cross-examined by Mr. Rendal, witness said that he understood that the principal tenant of the Aat had left a month before the visit of the police.

G.B.S. DENOUNCES FILM CENSOR.

Mr. Bernard Shaw has made a vigorous denunciation of the action of the film censor in banning "The Night Patrol," a fim depicting life on the Thatnes Embankment,

"There is no end to the craziness of this censorship business," he de- clared. "I can only ask Mr. Ed ward Bäorte (the film censor) pub- licly what he supposes he is paid for, and what difference it would make to public morals if his office were abolished.

The Magistrate, in giving his de- cision, said that it would be as great a risk to say that the pam- phlets belonged to any one of these men as it would be to say that it belonged to all three. A distinction could not be made, and his 'Wor- ship was reminded of a story told by "Sir Henry Gollan of a case in Bermuda where three prisoners were found tied together in a prison cell, one morning-one of them murdered. One of the aur viving prisoners must have done the deed but it was impossible to say which, and both were acquitted. It was the same in this case. Nothing belonging to the first defendant was found, and it could not be said that the mere presence of the printed matter on top of the property of the second and third defendants meant that it belonged to either of them.

Another point was that Sergt. Donovan announced his identity before entering the flat. If the de- fendants had been aware of the nature of the papers beneath the bed they would surely have either got rid of them, or concealed them in a better place.
