Subject as in this Act mentioned the county council shall, in the transaction of the business by this section transferred to them, possess and be subject to all the powers, rights, duties, capacities, 10 liabilities, and obligations which the quarter sessions, or any com- mittee thereof, were possessed of or subject to in conducting the business so transferred.
All business of the quarter sessions not transferred by this Act to the county council shall be reserved to and transacted by such 15 sessions in the same manner, so far as circumstances admit, as if this Act had not passed, and shall for the purposes of this Act be deemed to be judicial business.
If any question arises or is about to arise as to whether any business is or is not within the jurisdiction of a county council or 20 the quarter sessions, such question may, on the application of the chairman of quarter sessions or of the chairman of the county, be submitted for decision to the High Court of Justice in a summary manner; and the High Court of Justice, after hearing such parties and taking such evidence (if any) as it thinks just, shall decide the 25 question, and such decision shall be final.
The power given by this section to the High Court of Justice shall be deemed to be in addition to and not in exclusion of any other mode of trying any question.
