SUPREME COURT.
IN SUMMARY JURISDICTION. (Before Mr. A. G. Wises, Acting Pulins, Judge.)
THE BRANDT-RAMJAM CASE. - The hearing of this case, adjourned from Thursday, wai resumed to-day. Mr. Hastings appeared for the plaintiff, and Mr. Caldwell for the defendant. Mr.. Dennys was present on behalf of Ho Tim.
ין
The cross-examination of the defendant was resumed. He said: I admit that the plaintiff made the contracts between Ho Tim and myself. I did not make any agreement with Ho Tim to settle them. I swear it.
Mr. Hastings-Did you write this letter on the 11th Sept?-Dear Ho Tim-In consideration of your paying me, in cash, within this current week, or, in case of need, Monday next, the amount of $4,000.75 cents, in which sum you are indebted to me, and signing a promissory note for $1000, payable in two years, and another for $1000, parable in four years, I am willing to cancel all our future transactions in China Sugars up to December next, consisting of your sundry purchases from me.Is that your letter P.
Brandt admitted that it was his letter, but denied that the transactions on which Ramjam claimed brokerage were included. One was with "the concerned," and the other with Ho Tim. Mr. Hastings was simply fishing for evidence as far as Ho Tim was concerned. He wanted to
see the papers, as he had to be very careful
Mr. Hasting-Yes, you need to be very careful a good deal more careful than you have been. Brandt continued did not know that He Tim was the principal in the contract which Ramjam signed "for the concerned." I wish to correct that answer-I, was told so, some time before the settlement, but I did not find out.
Mr. Hastings-You refer in this latter to "future" transactions, what were they?—They were different contracts between us.
Cab you give us particulars ?—I can tell you somewhere about.
Where is your memo.. book-I gave you notice to produce it-I haven't got it.
Then you must send for it.~Ï haven't got it now.
►
His lordship-Why, have you destroyed it? "THE HONGKONG DISPENSARY, [sYes. I tore it up since the last time, as all
my transactions in it were finished,

LOCAL AND GENERAL. THE P. & O. S. N. Co.'s extra steamer Teheran left Bombay, for this port on the 14th inst., at 1 p.m.
THE agents (Messrs. Gibb, Livingston & Co.) inform us that the "Ben" Line steamer Benalder left Singapore for this port to-day.
Have you received any money from Ho Tim under this agreement? I bave not. In the first place that is not an agreement-yous call it one I don't.
I don't want to squabble about words don't, but it is a very important point.
Have you received any money under this agreement I cannot answer, because it is not an agreement.
Have you received any money in respect of these shares from Ho Tim ? Be careful, now; take time to answer.-What shares do you refer
to?
To those mentioned in the letter-Let me read the letter (a pause) I have not received any money in respect to the pending share
transactions.
His lordship-Are these the shares you mean, these mentioned in the letter?
Brandt-I have received no money in respect
to them.
Mr. Hastings-Have you received any money from Ho Tim under this agreement have
Well, do you admit that he has received nothing I do not. I don't deny it, but I don't admit it.
Well do you admit that you have received, yourself and on your order, $3,250 in respect to the matters mentioned in the letter -I don't admit anything of the kind.
You are suelag Ho Tim in this Court on these Sugar contracts, are not you -Am I obliged to answer that question?
amount --No.
a
His lordship-It may help the matter. Brandt Yes, I am sucing him. Mr. Hastings Are you sueing him for the full Will you undertake to swear that Ramjam never told you that the principal in the too sugar shares contract was Ho Tim ?—Yes,
That he did not tell you before the 11th Sep- tember ?-He decidedly did not. He said it was some other person, not Ho Tim. He said it was a sort of syndicate.
His lordship-You are not contending that the terms of the letter have been ever carried out, Mr. Hastings?
Mr. Hastings-No, I say everything has been paid up, either in cash or promissory notes. If anything has been paid I submit that it will be sufficient to prove brokerage.
His lordship-It will prove a settlement. Mr. Hastings-You say you have destroyed your memo-book since the last hearing 7-Yes. Have you any other books in which you enter your share transactions ?-No.
Have you got a yellow book -I don't think I have.
Have you no books at all now; ?—No. You carry all your numerous share transac- tlone in your head ?--Yes,
That concluded the cross-examination. Mr. Hastings asked permission to call rebut ting evidence, as several points had arisen of which he had had no notice.
Mr. Stokes, share broker, was then called, and stated that the rate at which Sugar shares were quoted on the 17th July was $284, falling to $10 on the 30th. At that time the abarcs were in rather a peculiar position in the market, and it was impossible to give any but cash quotations.
sales were $293-

By Mr. Caldwell-It would not have been extraordinary if the rates for three months future Ramjam was then recalled. He said:-I wrote to Brandt on the 19th November, asking him to pay me the $475 and $50 brokerage, as I was pressed for money, and was going to be ned. He came to my affice with the letter me at the end of the month, but what he did not want me to press him then, as he had no money. I had told him before he wrote that letter to Ho Tim, that the latter was the principal in the contract which I had signed for the concerned." I see the alteration at the end of the order he gave to Ho Tim. It is in my wilting, but made at his request, in the presence of both of them. Brandt had not signed then. He altered the date after that.
By Mr. Caldwell I forget when I got the $1,000 some time in October.
He Tim, broker, having been swam on the 4th Ezekiel, said-I bought 200 Sugar abates from the defendant, too for October and 100 November. I signed for one too, and the plaintiff, my broker, signed for the other 100. made a settlement with Brandt on the rath September, in Ramjam's office. All the contract note we give two notes, dhe, one pay 84200; 75 etc, and give two notes, due, one in two years for $1,000, and one in four years for Boo. I sent the notes the 8th October, and he returned them next day,
By Mr. Caldwell-I owed Brandt $4,000 on share transactions on the 11th September. That was on our transactions, in Sugars in August week, and I agreed, but when I paid him $1,000 he agreed to extend the time. I had a diamond ring on my finger at the time, and he said “You had better give one this for the delay; I will give it my wife" and he took it from my finger, (laughter). It was arranged that I should pay Ramjam lostead of him. I have the letter which he wrote rejecting my promissory notes, I don't know where it la

If the defendant's story is true he is not. As in many other caser regarding shares, the evidence is simply that of the plaintiff and the defendant, but on the plaintiff's part a witness is produced who repeats a certain con- versation, which took place in the middle of last about repaying $400 about the end of the month, month, in which the defendant said something Thus, if unexplained and uncontradicted, might corroborate the plaintiff's statement. Defendant gave a plausible explanation as to this, and 1 may say that he was not contradicted in any way. Therefore I think his evidence is entitled to some weight. With reference to the plaintiff's story, one feature strikes me as very curious indeed. If he never bought these as shares from the defendant at the end of July it is clear that he knew, if not before the 6th September, at any rate before carrying it out, yet he went and settled for them-he does not plead that it ∙was done by fraud, and I can only say that it was done in a generous spirit. The defendant construes that to mean that Belgium. The Archduke Francis will shortly the shares must be actually tendered and be transferred from his regiment in Prague to accepted. I don't think that is the meaning of Pesth. it at all; it seems to me if the seller and purchaser came to any arrangement then and there the plaintiff is entitled to his brokerage. If there is any dispute that is a matter between them, They might go on shilly shallying and fighting between themselves, and the broker would never get his brokerage. A further defence set up was the letter of the 11th September, in which defendant speaks of future transactions in China Sugars. He says he did not include the 100 shares claimed for here, as they were signed for the concerned," and he did not know that Ho Tim was the buyer. I am of opinion that he did know, and I give judgment on this for the plaintiff, with costs.

THE LOSS OF THE "NYLGHAU"

"The fall of Louis Philippe was to a great extent due to the Duc de Praslin having murder- ed his governess, but that crime compared favorably with that of the titled miscreants. Very possibly our Government of the classes is of the opinion that the revelations which would ensue were the criminals put on trial, would deal blow to the reign of the classes and to the popsocial influence of the aristocracy. Let them, however, understand that they will not be allowed to protect their friends. It would. really be too monstrous if the crimes which, when committed by poor, Ignorant men, lead to sentence of p ̃nal; servitude, were to be done with impunity by those whom the Tory Government delights to honor. I warn Mr. Matthews that if he does not take action in this matter, there will be a heavy reckoning when Parliament meets.
The trial begins at Wadowice, in Galicia, to morrow, of a lot of persons who are charged with various malpractices in connection with the emigration of Austrian and Hungarian peasants to America. The preliminary investigation has already lasted a year, and during the whole of this time the accused, who comprise Pales, Hungarians and Germans, have been im prisoned.
Among the charges brought against the ac cused are those of imposture, robbery, extortion and bribery in connection with Austrian and Hungarian peasants, who, during a perind en tending over ten years, have been induced to emigrate to the United States by the prisoners. The latter comprise shipping agents, Govern ment and police officers, customs and railway officials and others who were in the pay of cer tain emigration agents.
The indictment declares that a positive slave trade has been carried on in Hamburg in con- nection with the emigration of Austrian subjects, while the crowning offense in the eyes, of the Austrian Government is that a part of the regular organization assisted Austrian deserters from the army to emigrate...

S. 1/4 S. from the castern extreme of the Pratas Shoal, and seeing that the ship struck somewhere on the eastern edge of the shoal as about 8,10 p.m., this would make the distance, 49 miles, run in rather more than four hours, which, seeing the state of the wind and weather, the Court consider is extremely improbable; and they are inclined to the belief that either the master's observations traced the ship too far to the S. I have no sort of sympathy with vigilance associations and other such private censors of morals, but between their wrying action and the home officers' action, in impeding the police and warning high-born criminals to get out of the jurisdiction of the British courts, in order to save them from prosecution, there is a wide difference.
