Farrell informed us of a potential problem if the British Council do not obtain exemption from the Education Dept's Ordinance 279. The major effect is that the local Fire Dept view fire-fighting for a school in a more stringent way than for offices and are asking for access for a fire tender to the furthest point of the building from the road. This necessitates constructing a road across a previously landscaped area, (partially on our site, partially adjacent) at an estimated cost of £200,000

He approximately (Hong Kong $2.2 million): if we are

unable to get planning permission for use of the adjacent land, the alternative would be to create an access road through our site at an estimated cost of £1 million. During our visit Mr Whittle and myself sought further advice/clarification. At the Coordinating Committee meeting Mr Reading stated that Farrell's should have been aware from the outset that i the British Council building would be designated a sher school and therefore need to comply fully with the

requirements of Ordinance 279: the current exemption is because they occupy a converted building not purpose built.

Mr Smith-Laittan suggested that we may need to take legal advice. At our meeting with Swire, John Holdaway confirmed that the British Council should be exempt from the full requirements of Ordinance 279 as they teach only one subject English: Mr Holdaway agreed to carry out further research, discuss with British Council HK and then report back to Mr Whittle.
