1. I enclose a copy of Ms Barrett's minute of 18 January concerning the treatment of Taiwan under the Montreal Protocol. You will note that Ms Barrett is of the view that the solution proposed in Mrs Leslie's minute of 2 December would be a legitimate interpretation of Article 4 of the Protocol. However, as Ms Barrett points out, there are certain steps we need to take with our EC partners to ensure that we do not put ourselves in the position of being in breach of EC law.

When I spoke to Maria Nolan earlier this week she explained that the Commission are in the process of drafting a new Regulation to implement the controls on halons and methyl bromide within the Community. The intention is that this Regulation will adhere more closely to the wording of the Protocol and refer to "any State not Party" rather than "non-Parties", the term used in Regulation 594/91. I understand that the Commission also intend to include a definition of the term "non-Parties", where used in the previous Regulation, as meaning "any State not Party". should be grateful to know if this accurately reflects the
