(a)
one Participant is required under its customs laws to inform either the competent authorities in any
other territory or the Administration of a Customs
Union, or both, of contraventions or suspected
contraventions; or
(b) the supplying Participant expressly approves in writing and the law governing the receiving Participant allows such other use.

communications provided to one Participant pursuant to this Cooperative Arrangement will be accorded the
same
protection
in the territory of the receiving Participant as is afforded to documents and information of like nature under the law of
the receiving Participant's territory.

Inquiries,
information,
documents
and
other
The
communication received by a Participant will, upon request of
the other Participant, be treated as confidential. reasons for such a request will be stated.

(1) The receiving Participant may not use as evidence
information and documents obtained in accordance with this
Cooperative Arrangement in proceedings and charges brought
before the courts except with the written
