In paragraphs 33 to 37 of the Affirmation the Applicant seeks

to relitigate his involvement in BMFL affairs and the

sufficiency of the evidence against him which was determined

conclusively against him in the committal proceedings and by

this Honourable Court upon review. These matters are for the

Court of trial, going to the credibility of a prosecution

witness, and are not relevant to the issue of the bona fides

of the Second Respondent.

10. I refer to paragraph 38 of the Affirmation of the Applicant

and in this regard refer to paragraph 7 of this my Affidavit

and again say that these proceedings are concerned with

offences alleged to have been committed in Hong Kong.

11. The matters referred to in paragraph 40 of the Affirmation are

not relevant to a criminal investigation in Hong Kong. advised by those instructing me and I verily believe that in

so far as there is any suggestion or implication that the

Government of Hong Kong has joined in any improper arrangement

merely to suit the convenience of the Malaysian Government and

thereby prejudice the Applicant in his trial, this is denied.

12. In paragraphs 41, 42 and 43 of the Affirmation the Applicant

is seeking to give secondary evidence of documents which the
