when an action that may lead to the making

of an order for the purpose of confiscating the proceeds or instrumentalities of drug trafficking is commenced in a court; or
when a person is charged with an offence after having been taken into custody
without a warrant.".

Explanatory Note
The Drug Trafficking (Recovery of Proceeds) Ordinance (Cap. 405) provides for the enforcement of confiscation orders made by courts in the countries and territories designated under the Ordinance. This Order adds Malaysia to the list of countries and territories designated under the Ordinance.
It also specifies the
appropriate authority in Malaysia and the steps which when taken there constitute the institution of proceedings for the purposes of
the Ordinance.
