DRUG TRAFFICKING (RECOVERY OF PROCEEDS) (DESIGNATED COUNTRIES AND TERRITORIES) (AMENDMENT) ORDER 1992

(Made by the Governor in Council under section 28 of the Drug Trafficking (Recovery of Proceeds) Ordinance (Cap. 405) with the approval of the Legislative Council)

1.

Appropriate authority

Schedule 1 to the Drug Trafficking (Recovery of Proceeds)

(Designated Countries and Territories) Order 1991 (L.N. 19 of 1991)

is amended by adding after the item relating to "Jersey"

"Malaysia

The Inspector General of Police or a person

designated by him".

Modifications of the Drug Trafficking

(Recovery of Proceeds) Ordinance

Paragraph 20 of Schedule 2 is amended in the new Schedule 1A by

adding after the item relating to "Jersey"

"Malaysia

(a)

(b)

when an action that may lead to the making

of an order for the purpose of confiscating

the proceeds or instrumentalities of drug

trafficking is commenced in a court; or

when a person is charged with an offence

after having been taken into custody

without a warrant."
