of the election committee according to the allotted quotas and election method prescribed in the election law.
Members of the election committee shall vote in an individual capacity.
4. Nominations of candidates for the chief executive can be made by no less than 50 members of the election committee. Each member can only nominate one candidate.
5. The election committee shall elect, from the list of nominees, candidates for the chief executive by secret ballot and on
a one-person-one-vote basis. Specific details for election shall be prescribed in the election law.
6. The first chief executive shall be selected according to the "Decision of the NPC on the Formation of the First Government, Legislature, and Judicial Organs of the Macao SAR".
7. Revision of the method for selecting the chief executive in the year 2009 and after shall be adopted by two-thirds of the members of the legislature and agreed by the chief executive and be reported to the NPC Standing Committee for approval.
APPENDIX II: METHOD FOR CONSTITUTING
THE LEGISLATIVE COUNCIL OF THE MACAO
SAR
1. The first legislative council of the Macao SAR shall be constituted according to the "Decision of the NPC on the Formation of the First Government, Legislature and Judicial Organs of the Macao SAR”.
The second legislative council shall be composed of 27 members, of which 10 shall be returned by direct election, 10 by indirect election and seven by appointment.
2. Specific details for electing members of the legislative council shall be prescribed in the election law submitted by the Macao SAR government and approved by the legislature.
3. Revision of the method for constituting the legislative council of the Macao SAR in the year 2009 and after should be adopted by two-thirds of the members of the legislature and agreed by the chief executive and be reported to the NPC Standing Committee for the record.
APPENDIX III: NATIONAL LAWS APPLICABLE
IN THE MACAO SAR
The following national laws will be promulgated or legislated locally on 20th December 1999 by the Macao SAR:
1. "Resolution on the Capital, Chronology, National Anthem and National Flag of the PRC"
2. "Resolution on National Holidays of the PRC”
3. "Declaration of the PRC government on Territorial Waters"
4. "Citizenship Law of the PRC”
5. "Regulations of the PRC on Diplomatic Privileges and Immunities"
6. "Regulations of the PRC on Consular Privileges and Immunities"
7. "National Flag Law of the PRC”
8. "National Emblem Law of the PRC"
9. "Law on Territorial Waters and Contiguous Areas of the
PRC"
Decision of the NPC on the Method for the Formation
of the First Government, Legislative Council, and Judicial Organs of the Macao SAR (Draft Substitute)
1. The first government, legislative council and judicial organs of the Macao SAR shall be formed in such a way as reflects the national sovereignty and ensures smooth transition.
2. The NPC shall set up a preparatory committee for the Macao SAR. The preparatory committee is in charge of preparing all matters relating to the establishment of the Macao SAR and formulating specific measures for forming the first government, legislative council and judicial organs in line with this decision. The preparatory committee shall comprise members from both mainland China and Macao, with no less than 50% coming from Macao. Both the chairman and members of the preparatory committee shall be appointed by the NPC Standing Committee.
3. The Preparatory Committee for the Macao SAR shall set up an election committee to form the first government of the Macao SAR (simplified as the election committee hereunder).
The election committee shall consist of Macao's permanent residents only, with broad representation. Its members shall include NPC deputies; members of the National Committee of Chinese People's Political Consultative Conference; people who have formerly held offices in the administrative, legislative and advisory organs before Macao was turned into a special administrative region and who have practical experience; and representative figures from various strata and sectors of society.
The 200-member election committee shall be broken down as follows:
Industrial, commercial, and financial sectors - 60 people Cultural, educational, and professional sectors - 50 people Labour, social service, and religious sectors - 50 people Former political figures, NPC deputies and members of the National CPPCC Committee - 40 people
4. The election committee shall select or nominate a
candidate for the first chief executive through local consultation and then submit the candidate to the central people's government for appointment. The term of the first chief executive is the same as the normal term.
5. The first chief executive of the Macao SAR shall form the first government in line with the Basic Law of the Macao SAR. 6. The First Legislative Council of the Macao SAR shall comprise 23 legislators; eight shall come from direct elections, eight shall be elected indirectly, while the remaining seven shall be appointed by the chief executive. Should the composition of the last Macao legislative council conform to both this decision and pertinent provisions of the Basic Law of the Macao SAR and should its elected legislators endorse the Basic Law of the Macao SAR of the PRC, be willing to pledge allegiance to the Macao SAR of the PRC and meet the conditions stipulated in the Basic Law of the Macao SAR, they can be confirmed by the Preparatory Committee for the Macao SAR and become legislators of the first legislative council of the Macao SAR. Any vacancies will be replenished by the Preparatory Committee for the Macao SAR.
The term of the first legislative council of the Macao SAR shall last until 15th October 2001.
