(4) Where any person is entitled to exercise an option for his case to be governed by one of two or more laws, the law specified by him in exercising such option shall, for the purposes of this clause, be deemed to be more favourable than the other law or laws.

14c. (1) The provisions contained in the Tenth Provisions Schedule to this Agreement shall have effect with Schedule to respect to the public service and retirement there- have effect. from and to the grant of compensation, pensions, gratuities and other like allowances.
(2) There shall be charged on and paid out of the general revenue and assets of the Federation without further provision or appropriation all compensation, pensions, gratuities and other like allowances granted in accordance with the provi- sions contained in the Tenth Schedule to this Agreement, and all other pensions, gratuities and other like allowances granted in respect of public service.".
3. Immediately after the Ninth Schedule to the New Tenth Agreement there shall be added as the Tenth Schedule Schedule. to the Agreement the following new Schedule:
TENTH SCHEDULE (Clause 14c)
PART I
COMPENSATION TERMS
1. (1) In this Schedule, unless the context otherwise requires Interpretation.
"the appropriate law" means, in relation to any officer, the law 'governing the grant of pensions and gratuities for the time being applicable to such officer:
"compensation for loss of career" means lump sum compensa- tion calculated in accordance with the provisions of Part III of this Schedule;
"earned pension or gratuity" means the pension or gratuity which an entitled officer may be entitled to receive under the provisions of paragraph 7 or 9;
"entitled officer" means an officer of Class A, Class B, or Class C, who is serving on the operative date in a public office in the Federation, and who has not reached his fifty-fifth birthday or being a Judge has not reached his sixty-second birthday; and alt
“officer of Class A" means an officer in receipt of expatriation pay, other than an officer of Class C or Class D, but does not include an officer serving on contract or agreement for a specified period, or on temporary transfer;
