A summary of submissions and representations made by the Attorney General and the Secretary for the Civil Service on the use of special circumstances points is at Annex D. The Attorney General represents that experience in law translation should warrant additional points. He suggests that a minimum of one year in law translation is required before additional points would be awarded.

SPECIAL CIRCUMSTANCES POINTS AND ASSESSMENT OF REPRESENTATIONS

Law translation is carried out by Law Translation Officers who, on recruitment, are given three to six months full time training in law. This attribute is not captured in the computer data. By going through the applications manually, Immigration Department has been able to identify 7 applicants who are engaged in law translation. 4 of them are potentially

successful.

The Administration considers that people with experience in law translation contribute towards the development of a bilingual law system. It is desirable to ensure that a sufficient number of them are captured under the scheme. However, this group of applicants already has a high success rate (57% against 14% for the entire occupation), the award of special circumstances points to further enhance the chances of success is not recommended.

As for Special Circumstances points to recognise an applicant's exceptional merit or outstanding achievement, i.e. individual merit points, the criteria and methods of awarding these points have been clearly defined and published in "A General Guide to the British Nationality Selection Scheme" and Reference Manuals. After adding the individual merit points scored by individual applicants, the total provisional points scored by the potentially successful applicants range from 485 to 562. This differs slightly from the range of 482 to 562 points before the award of individual merit points. Under both circumstances, the same applicants are captured above the quota line and the profiles remain unchanged after the award of such points.
