on the Confiscation of the Proceeds of Crime

By copy of his letter of 22 August 1990 to Hill in Gibraltar, John Hawkins sent me for information a copy of the Council of Europe Convention.

As you know, we have to date adopted a strategy of seeking time-limited bilateral agreements for mutual assistance in the investigation and prosecution of drug trafficking offences, and in the recovery of the proceeds of drug trafficking. However, in light of the course the UK is likely to follow, We are now giving preliminary thought to the possibility of seeking extension of the Council of Europe Convention to Hong Kong, rather than seeking bilateral agreements with parties to that Convention. Any such extension would not, of course, be expected to continue beyond 1997, and in this connection we note that Article

Article 38(3) provides for the withdrawal at three months notice of the application of the Convention to any territory.
