Note by the Attorney General on the

Petition of CHAN Kan-sau

On 16 November 1979 the Petitioner was convicted

of murder and sentenced to death. Following unsuccessful

appeals against conviction and sentence his death sentence

was commuted to life imprisonment by the Governor in Council

on 5 April 1981. The Petitioner is aged forty-two and has been imprisoned for ten years.

This is the third petition made by or on the Petitoner's behalf, the last petition being made by the

Petitioner's mother in September 1988. The Petitioner

requests that his sentence should now be remitted to a

sentence of imprisonment for determinate period. The

Petitioner expresses remorse for committing the offence and states that he wishes to be re-united with his family

who are prepared to accept him. He regrets having incurred three reports for breach of prison discipline in his early

years of imprisonment and states that he has worked diligently in the prison workshop and acquired the skill

of sewing. He has been baptized as a Christian.

He

expresses a desire to turn over a new leaf,

leaf, re-unite with

his family and do something constructive for the community upon his release.

Circumstances

On the 9 December 1978 the Petitioner and three

others (one of who was his younger brother CHAN Kan-cheung), accompanied their triad society leader to collect gambling

debts. The four men were armed with a variety of knives
