Residency Rules
5.
A candidate, whether or not of UK origin, should have lived in the United Kingdom for a minimum of 5 years immediately preceding application. In exceptional circumstances a shorter period of residence may be permitted but a waiver of the full 5- year requirement cannot be guaranteed.
6.
Waivers of the 5-year rule can be considered in the following
circumstances:
a.
The candidate is of UK origin and the UK is regarded as the candidate's parents normal place of residence. (This applies to those born in the UK or born overseas because parents are on Crown Sevice)
b.
The candidate has some UK residence defined as
follows:
(1) A minimum of 12 months residence in the
5 years immediately preceding the application, or,
(2) If UK born, a total of 5 years residence at any time, or a lesser period if the
non-UK residence is entirely in Australia, New
Zealand, Canada or the Republic of Ireland, and
the requirements of sub-para 7b below are met.
(3)
Any period if the requirements of sub-paras 7a
and 7b below are met apart from current UK
residence.
7.
Candidates with no UK Residence. Non-UK residents, who fail
the provisions of paras 5 and 6 above, may only be considered for
a waiver if they satisfy both of the following conditions:
