This partial authorization, subject to timely authorisation of the remaining areas,

should enable construction for the known advance works to proceed on schedule. Deferring authorization for the remaining areas until the footprint of the new airport is known would obviate the unnecessary extinguishment of rights in areas which will not actually be needed for the construction of the airport. This would also enable the concerns of some environmentalists such as the Green Lantau Association to be addressed.

Option (d)

Authorisation of whole reclamation subject to

modification and conditions

Due to

the urgency and importance of the project the Governor in Council may consider it appropriate to authorise the whole reclamation now subject to any modifications and conditions considered appropriate.

FINANCIAL IMPLICATIONS

The proposed civil works and the construction of the new airport will be carried out by the Provisional Airport Authority (PAA) with a combination of public and private sources of finance. On 13 July 1990, the Finance Committee of the Legislative Council approved an advance of $500 million from the Capital Investment Fund to the PAA for implementation the advance works. Upon authorization of the reclamation person who considers he has an interest, right or easement in or over the area of foreshore and sea-bed affected may submit a claim within 12 months. Such claims are not expected to be substantial, and will be met from the Capital Works Reserve Fund, Head 701, Land Acquisition.
