ARTICLE 4

CGWIC'S SERVICES

CGWIC undertakes to perform the Services in accordance with the terms and conditions of this Contract.

The Services described in Paragraph 4.1 consist of the Standard Services and the following Optional Services:

(a) Such Optional Services as described in Section 2 of

Annex II under the heading "Optional Services Ordered by Client" that have been ordered by the Client; and

(b) Such additional Optional Services set forth in

Section 2 of Annex II under the heading "Additional Optional Services which may be ordered by Client" which are ordered by the Client after the date of signature of this Contract in accordance with the terms specified in said Annex.

It is acknowledged by the Client that CGWIC has no control (other than such control as would enable CGWIC to destroy the Launch Vehicle and the Payload) over the

The Launch Vehicle after the Launch has taken place. Services, with the exception of any Services to be performed after Launch and the performance of any Reflight or refund obligation contained in Article 11 hereof, shall therefore be deemed to have been accomplished immediately upon Launch.

CGWIC's obligations hereunder include, subject to the terms and conditions of this Contract:

(a) the preparation of the Launch Vehicle for the Launch

Mission, having regard to the Launch Opportunities and the proposed Launch Day and the schedule for the Launch of the Payload;

(b) the provision of all services and facilities at the

Launch Base and elsewhere in China as are required to enable the Payload to be unloaded at Xichang Airport and transported to and within the Launch Base and to be prepared by Client for loading on the Launch Vehicle and such other services and

facilities as are otherwise required to be provided by CGWIC under this Contract; and

(c) the use of its best efforts to accomplish a

successful Launch Mission.
