It is desirable that there should be a waiver of local criminal and civil jurisdiction in respect of matters resulting from the performance of official duty during the evacuation. In many countries jurisdiction arrangements already exist which would be adequate for the purpose (eg in NATO countries and some Commonwealth countries). arrangements do not exist, an attempt should be made to obtain an undertaking from the Government concerned, and a request to do so will be transmitted from the FCO to HM Representative if the occasion arises. This will be without prejudice to HM Government's decision as to whether or not the evacuation should proceed.
