Apart from our client, no one sells building materials in the vicinity. If our client cannot operate his
business on the said lands, the residents in the area shall have to go either to Yuen Long or Sheung Shui when they have to buy construction materials.
The livelihood of our client depends entirely on the
business of 会誠建等材料 If our client wishes to operate the same business, he shall have to buy another piece of land within the same area so that he has a place in the area to operate his buisness and maintain his links with his old customers. Our client has not been' able to find a piece of land suitable for his purpose so far.
In fact, the Government proposes to resume the said lands as early as 1982. A copy of the letter dated 17th March 1982 from the Housing Department showing the intention of the Government to resume the said lands is annexed hereto marked "B". In view of the said intention, our client entered into a Sale and Purchase Agreement with the owner of two pieces of lands known as Lot No.3253 Sec.A and Lot No.3279 Sec.C.s.s.1 for the purchase thereof and paid a sum of $30,000 as deposit to the said owner. Our client also wrote a letter to the Government requesting the Govern-
to allow it to use the same building licence to erect a 3-storey house on the two pieces of land after the said lands and the house thereon were resumed. Government indicated in the two letters that the resumption proposal was dropped for the time being. Copies of the two letters are annexed hereto marked "C" and "D". As a result of the change of mind of the Government, our client gave up his plan of purchasing the two pieces of land and the deposit of $30,000 was forfeited by the said owner consequently. This incidence, clearly shows the need of our client to own a piece of land in the area and how our client was to suffer financial loss due to no fault of his own.
The
Our client wishes to suggest the following two alternatives to the Government: -

The location of the said lands is shown and coloured green and yellow on the Survey Plan. The said lands are on side of the Castle Peak Road and the lands on the other side of the Castle Peak Road are used for agricultural purposes instead of domestic and commercial purposes as in the case of our client's lands. Resumption of these lands by the Government will have less adverse effect on the owners thereof; or
