TERVIEW WITH THE PRISONER

The prisoner was interviewed at Stanley Prison on 22.9.81.

He was very anxious and shivered during the interview. Furthermore, he frequently lowered his head to avoid direct visual contact with the investigating officer. Nevertheless, he was verbal and co-operative in revealing his social history and feelings.

The prisoner denied to have any pre-meditation of killing the deceased or wounding the deceased's brother. He also insisted that the offences were neither the result of personal grudges against the victims nor monetary dispute with them. He attributed them to his fit of anger and impulsiveness. He deeply regretted for his law-breaking behaviour and knew that it was unforgivable to kill his cousin. He was so shameful that he dared not face any of his clansmen and friends again. Although the prisoner accepted the retribution for the offences, he still begged for mercy.

SUMMARY

After completing Middle School Class Three and having been a farmer in China for five years, the prisoner illegally came to Hong Kong to look for a better life. Since his arrival in October, 1978, the prisoner had been engaged in gainful jobs like working at construction sites, meat shop and eventually at the Cheung Sha Wan Abattoir.

Though the prisoner managed to make a living over the nest he could not get along harmoniously with his two cousins YEUNG Wai-sheung, the wounded victim and the deceased respectively) who also illegally came to Hong Kong sometime in 1979 and lived with the prisoner since. then. Besides some conflicts over trifles, the prisoner was not very happy over the monetary dealings with the cousins due to the purchase of a hut in May 1930. Even worse, he said that he was mistakenly accused and condemned by the cousins to have indecently assaulted the deceased and Madam TIN Tze- lung. This had further strained the relationship among the prisoner and his cousins.

Allegedly, on 28.1.1981, the prisoner had a furious argument and fight with the younger cousin, YEUNG Wai-sheung, over the excessive sound volume of a tape-recorder and had killed her during the struggle with her. He also wounded

when the latter discovered the body of YEUNG Wai-sheung under the bed. The prisoner expressed his deep regret for his misdeed and claimed that he did not intend to commit the present offences purposely but had done so due to his fit of anger and impulsiveness.

As a person, the prisoner was generally described as a pleasant, likeable and amiable character among his friends, a helpful and affectionate member of the family and a conscientious and diligent employee in his job.
