REVISION OF IMMIGRATION RULES

1. We have been sent the attached side-copy of Mrs Reisz's submission of 30 July about the White Paper on the revision of the Immigration Rules. It also touches upon the timing of publication of the government's reply to SCORRI and the Rayner Work Permit Scrutiny. So far as I can see there is nothing to disturb us, but we should examine the points that concern us quickly as the Home Secretary's letter can be expected to arrive very soon, Points that concern us seem to me to be as follows:

White Paper on Immigration Rules

(a) The decisions taken at 'H' Committee on 14 June (with which

we concurred) are being implemented.

(b)

The formal changes are mostly consequential upon the Nationality

Act.

NTD should therefore be asked to scrutinise the draft. That department was presumably responsible for the request (para 13 of Mrs Reisz's minute) about acceptance of passports issued by Foreign States or Governments, If not, we should find out what department does have the interest and check the passage with them.

(c) Para 7 appears to meet HKGD's concern, But we should check with

ECD(I) should see the parts that concern European Community

nationals.

The provision on returning residents presumably is consistent

with our recent circular.

The minimum amount required of businessmen, the self-employed

and persons of private means is being raised to £150,000 capital or £20,000 income. It is as well to make this change to avoid misunderstanding: but I am still not sure that it meets what is in practice being required.

A guidance telegram to posts will be needed shortly before the

White Paper issues. Information Department should be alerted to this (although it is still some some two months distant).
