Re: Termination of Service
On 20th November 1978 I went, at the request of Superintendent R.C. Lidster to Police Headquarters, Arsenal Street, Hong Kong and specifically to the office of Senior Superintendent J.G. Mansell, Senior Staff Officer, Personnel Wing. I was handed by him two letters, one dated 14th November, 1978 and signed "Alisdair Sinclair for Secretary for the Civil Service" and the other a copy of a letter signed R.C. Lidster and dated 20th November, 1978.
The letter signed by Mr. Sinclair was addressed to me
and informed me that my service is to be terminated with effect from a date to be determined by the Commissioner of Police in accordance with paragraph 14 (1) (a) of the Memorandum on Conditions of Service for Overseas Officers.
A copy letter signed by Superindent Lidster was addressed to the Secretary for the Civil Service and stated that my services will be terminated with effect from 4th December, 1978
I had no prior notice that consideration was being
given to terminate my service.
Neither letter made any mention of the reasons for which the decision to terminate my service had been taken and I was not invited to comment on the decision or given an opportunity to question the factors giving rise to it.
Upon reading the letters referred to I asked Senior Superintendent Mansell for the specific reasons leading to the Notice of Termination. He told me that it was not necessary to be given specific reasons.
I was at that time aware that in about July 1978 a complaint had been made to the C.I.D. at Yuen Long by a Chinese male that I had incited him to commit an indecent act with him. I had been intervied about this matter by Detective Chief Inspector Rich at Yuen Long Police Station and I had made a full statement denying the allegation. I was told by Detective Chief Inspector Rich that the matter would be "fully investigated". I have not been charged with any offence arising out of this complaint and no disciplinary proceedings have been instituted against me.
I asked Senior Superintendent
Mansell whether the alleged incident I have referred to above was the reason for terminating my service and he informed me that the Director of Public Prosecutions had studied the file relating to the complaint and that he considered that the papers thereon disclose "a prima facie" case against me but Senior Superintendent Mansell declined to expand on this at all and would not say what offence the D.P.p. considered was disclosed.
