Objection from Lee Kau (Objection No 1) (Annex C)

The objector is the operator of the Man Wo Store situated on Lots No 1801, 1802 and 1747 in Demarcation District No 7 at Tai Hang, which are prewar new grant building lots. He is not the owner of the lots in question. The stated ground of objection is that he will lose his business as his store will have to be demolished to make way for the proposed undertaking.

Due to the close proximity of the railway and large water mains on the east side of this section of Taipo Road, any road widening to accommodate the second carriageway can only be made on the west side of the existing Taipo Road where the Man Wo Store is located. It is therefore necessary to acquire the lots and demolish the building thereon. Upon clearance, the objector will be offered the usual rehousing and ex-gratia shop allowance by Director of Housing according to existing policy. The objector has been advised of this but is still unwilling to withdraw his objection.

As it is not possible to avoid the clearance of the shop in question for the reasons given above and because of the need to proceed with the road widening project to improve communication to Sheung Shui/Fanling area from the south it is recommended that the objection should not be upheld.
Objection from Lee Cheung (Objection No 2) (Annex D)

Mr Lee Cheung runs a metalware workshop in a temporary structure on Crown land. He objects to the proposed undertaking as his workshop will have to be cleared to make way for the project. He has also requested that Government should make reasonable reprovisioning arrangements for him.

As Mr Lee's workshop is a tolerated structure on Crown land, he will be eligible for domestic rehousing and ex-gratia compensation payable to squatter industrial undertakings upon clearance. He has been advised of his eligibility for domestic rehousing and ex-gratia compensation but is still unwilling to withdraw his objection.

As in paragraph 6 above it is recommended that the objection should not be upheld.
