Objection from Mr Man Tat-pui (Objection No 3) (Annex E)

10

Mr Man is an indigenous villager of Tai Hang Village and owns a village-type house on a new grant building Lot No 1910 in Demarcation District No 7. His ground for objection is that his house will be affected by the proposed undertaking.

11

As the lot involved is a new grant building lot with a village-type house standing on it, the objector will be offered land in exchange for his existing lot with a new village house according to the terms of village removal policy. If the objector accepts this offer, formal resumption proceedings will not be required.

12

The objector has been informed of his entitlements under the village removal policy but is still unwilling to withdraw his objection, because of the fear that his claims for compensation/ exchange may be jeopardised if the objection is withdrawn. However, as his eligibility under the village removal policy has been established, it is recommended that his objection should not be upheld.

They will only be offered a building site in exchange for the land surrendered but they will not be getting a new village type house built for them as well.

As in paragraph 12 above, it is recommended that the

objection should not be upheld.
