would have been required for the Tsuen Wan North Development even if the MTR had not been extended to Tsuen Wan. The siting of the MTR station and depot in Area 6 will result in the need to resume certain multi-storey buildings including a school which would not otherwise have been affected, but which must now be demolished. These buildings which are referred to in paragraphs 4 and 5 of memorandum XCC(78)8, will be resumed, in the case of those directly affected by railway cons- truction works, under the Mass Transit Railway (Land Resumption and Related Provisions) Ordinance (Chapter 276) and in the case of those affected by consequential replanning, under the Crown Lands Resump- tion Ordinance (Chapter 124). In both cases, the resumptions are subject to the provision of funds by the Finance Committee of the Legislative Council, and the resumptions under the Crown Lands Resumption Ordinance will require a separate submission to be made to this Council.

Approximately 30% of the private land is under cultiva - tion, and the rest is occupied by 350 village houses, 7 schools, 3 churches, one Budhist nunnery, three temples, and about 3, 100 domestic, commer- cial and agricultural temporary structures. There is approximately 18 hectares of Crown land involved, occupied mainly by surveyed domestic and agricultural structures.

In addition, in Phases I, II and IV, there are about 250 industrial establishments (mainly metal works, weaving and plastics (PVC) manufacturing) operating on 15 building lots and in approximately 850 surveyed temporary structures under temporary modifications/ Short Term Waivers on private land or Crown Land Licences/Short Term Tenancies. Ex-gratia allowance for the industrial and commercial undertakings may be payable to the eligible operators in accordance with current policy subject to screening to be undertaken by the Director of Housing.

The clearance will also involve payment of compensation for crops, bamboos, fruit trees, pine trees, ex-gratia allowance for cultivators, ex-gratia disturbance allowance for displaced pig and poultry breeders, the removal of formal graves and urns together with "tun fu" ceremony fees, and compensation for miscellaneous items (accommoda- tion works) e. g. wells, boundary walls and fences.

A total of about 3, 950 temporary structures (including domestic structures, shops and workshops) and about 600 substantial buildings (including village houses) on building lots will have to be cleared. Eligible families will be offered public housing in Tsuen Wan. Families
