Please refer to my letter of 25 January 1978 about housing for the Chief Justice and the Attorney General.
2. I have now had a reply to my minute to ODM (copied to you) in which I asked whether they would consider increasing the allowances of these officers to enable them to rent a more suitable property or alternatively to allow them to claim a rent refund. I am afraid that they cannot concede such a request. Not only do ODM have no authority to make any such allowance but they consider that it would not be right for them to seek such authority since they would be immediately beset by similar claims from other OSAS officers who felt they were badly housed. Unfortunately sub-standard accommodation is more the rule than the exception for OSAS officers and though the Attorney General and Chief Justice are very senior they are still subject to OSAS conditions. In fact ODM point out that although Sir John Summerfield is receiving a nil OSAS 'supplement, his correct rate should be minus £888. In practice at present this gives him nothing but, were he to be awarded the £1200 suggested, it would immediately be reduced to £312.

3. I fear therefore that we can do nothing more at this end, I am sorry nothtogbacable to convey a more optimistic decision.
