(a) in subsection (1) by deleting paragraph (b)

and substituting the following

(b)

between the hours of 7 p.m. and

7 a.m. or on any public holiday,

uses or causes or permits to be

used any powered mechanical equipment

for the purposes of carrying out

any work, *;

(b) by inserting after subsection (1) the

following new subsection

(1A) It shall not be an offence

under subsection (1)(b) -

(a)

for any person to use or cause

or permit to be used a single

piece of powered mechanical

equipment for the purposes of

carrying out any work on or

within domestic premises:
