(i) the powered mechanical

equipment being used is of a

kind normally used or operated,

or has been so manufactured or

designed as to be reasonably

capable of being used or

operated, by holding the

equipment in the hand without

any other form of support; and

(ii) no more than one such piece

of powered mechanical equipment

is being used in the premises

at any one time;

(b) for any person to use or cause

or permit to be used any powered

mechanical equipment for the

purpose of ..

(i) preventing injury to any

person or saving the life of

any person; or
