Negotiations to obtain voluntary surrender of land are in pro- gress, but the institution of formal resumption proceedings is recommended to avoid delays which might be caused by succession difficulties, absentee owners or by negotiations which cannot be concluded satisfactorily within the time available. As the land to be resumed lies within the Sha Tin Outline Zoning Plan, the landowners will be offered the alternative of land exchanges or cash compensation including an ex-gratia compensation for agricultural land to bring the total compensation up to $10 per square foot. The majority are expected to accept the exchange offer, so that the amount of cash compensation to be paid will be reduced accordingly.

Honourable Members will be asked to advise, under section 3 of the Crown Lands Resumption Ordinance (Chapter 124), whether the re- sumption of the lots listed at Annex C is required for a public purpose, namely the reclamation and provision of a drainage system in Area 5, Sha Tin, New Territories.
