On 8th October 1974, after considering memorandum XCR (74)169 (Annex A), the Council advised and the Governor ordered the resumption of 3, 739, 462 square feet of private land in Areas 5 and 48 of Sha Tin New Town. The land was required for the implementation of a public housing project which was part of the Stage I development of the Sha Tin New Town. The land was subsequently reverted to the Crown on 1st February 1975 to enable the site formation works for the housing project to proceed.

The Director of Public Works has now recommended the re- sumption of an additional 85, 659 square feet of agricultural land at Tsang Tai Uk, Sha Tin, in order to carry out reclamation and drainage works in the area. The general location of the land to be resumed is shown coloured orange on the identification plan at Annex B. The Secretary for the New Territories is satisfied that the area of private land is the minimum necessary to implement this project, which is in Category A of the Public Works Programme. Work on the Crown land portion has already commenced in December 1976. Compensation for resumption and clearance is estimated to be $1, 235, 000 and funds are available to meet the expenditure.

The clearance will involve compensation for crops, pine trees, fruit trees and a number of miscellaneous items such as wells, irrigation pipes and fences. In addition, an ex-gratia allowance will be paid to enable villages to carry out five 'Tun Fu' ceremonies which they claimed to be necessary to safeguard against any possible 'fung shui' damage to Tsang Tai Uk as a result of the clearance. A small number of structures presently occupied by car breakers will have to be cleared, but no ex-gratia compensation will be paid for these as they were formerly covered by Short Term Waivers, and will be voluntarily cleared by the owners themselves upon expiry of the three months' notice of cancellation of the Waivers already served in December 1976. No domestic structures are affected, and re-housing arrangements will therefore not be

necessary.
