Crown Lands Resumption Ordinance (Chapter 124)

RESUMPTION OF LAND FOR GOVERNMENT PUBLIC HOUSING AT SHA TIN NEW TOWN AREAS 5 AND 48

The Housing Programme approved by Members on 17th October 1972 requires the provision of large numbers of public housing units at Sha Tin. Under the Sha Tin New Town development plan, land will also be provided for private housing, industry, community facilities and utility services. The Director of New Territories Development now recommends the resumption of 3,739,462 square feet of private land, comprising 11,441 square feet of building land and 3, 728, 021 square feet of agricultural land in Areas 5 and 48 Sha Tin New Town, for the implementation of the first stage of the public housing project. This project is in Category A of the Public Works Programme and funds for the resumption of land and clearance of the area are available within the approved project estimate. The is shown coloured brown on the identification plan at Annex A. Secretary for the New Territories is satisfied that the private land involved is the minimum necessary to implement the project.

In connexion with this resumption, the payment of crop compensation, disturbance allowance and ex-gratia compensation to owner and tenant cultivators on agricultural land, ex-gratia compensa- tion to pig-breeders who cannot be resited in the district and pine and fruit tree compensation will be necessary. Payments arising from the need to remove 247 graves and 400 bone pots in a traditional village burial ground in the area will also be made.

The villages of Tsok Pok Hang, Fui Yiu Ha, Sha Tin Wai, Wong Uk and Yuen Chau Kok will also be affected by this hcusing project, but not by the present resumption, and the Secretary for the New Territories is discussing removal terms with the villagers. However, the "fung shui" and environs of the villages will be affected by the resumption and "tun fu" ceremonies and the reprovisioning of 7 shrines will therefore be necessary.

The occupants of 152 domestic structures, comprising some 500 persons or 152 families, cannot be resited on Crown land elsewhere in the district and, subject to screening, may be eligible
