Under section 20(1)(a) of the Immigration Ordinance (Chapter 115), the Governor in Council may make a deportation order against an immigrant other than a Chinese resident, a United Kingdom belonger or a resident United Kingdom belonger who has been found guilty in Hong Kong of an offence punishable with imprisonment for not less than two years.

Mr Cheung was born on 12th January 1944 in Singapore. He claimed to have entered Hong Kong illegally from Singapore in April 1969 and to have remained here since without permission.

On 4th November 1976 officers from the Triad Society Bureau raided Mr Cheung's Tsim Sha Tsui apartment where an automatic tear gas pistol, twelve rounds of ammunition, three plastic imitation firearms and two batons were uncovered. Subsequently, a quantity of dies, watches and watch-bracelets bearing false trade marks were also found.

Mr Cheung was charged with 'possession of prohibited weapons', 'possession of imitation ammunition', 'possession of imitation firearms', 'possession of an offensive weapon in a public place' and 'possession of ammunition without a licence', convicted in the Central Magistracy on 12th November 1976 and sentenced to 12 months imprisonment on each of the first two charges, 6 months imprisonment on the third charge and 12 months imprisonment on each of the last two charges, all sentences to run concurrently. He was further charged with 'possession of dies for forging trade marks' and 'possession for the purpose of sale articles to which false trade description was applied', convicted in the Central Magistracy on 18th January 1977, and sentenced to 12 months imprison- ment on the first charge and 3 months on the second, the sentences to run consecutively. These last two sentences were also to be served consecutively to those relating to his previous convictions. With full remission he will be released from prison on 13th May 1978. The maximum penalties for Mr Cheung's offences vary from 3 months for 'possession of an offensive weapon in a public place' to 10 years imprison- ment (on indictment) for 'possession of ammunition without a licence'.
