I then arrested the accused on the present charge of murder. I formally

cautioned him. He made no reply. I took him to Call 19. About five

minutes late I served him a copy of the charge. Later that day, at about

2.35 p.m.

I went to the morgue at Peebles Hospital accompanied by Inspector

Blaize. A post mortem was being carried out by Dr. Smith on the body of

Evelyn Rabsatt. The body was identified to the doctor by me.

At the morgue,

I got from Dr. Smith one dress, one vest one petticoat, one black panty.,

one towel, one piece of cloth and a vial of blood from the body of the

deceased. I kept these in my custody. I produce the dress EXH. V.M. 12

I produce vest, petticoat, pants, towel and piece of cloth EXH. V.M. 13

I kept the vial of blood and now produce it.

At about 4.00 p.m. on 20/1/77 at Police Headquarters Cpl Williams

handed me a piece of cord. I kept it in my custody. I had seen it before

in the accused's room.

At about 5.00 p.m. P/C Blyden gave me a jar with a swab of blood taken

from the deceased's shop. I kept it in my custody.

On the 21/1/77 at about 7.30 a.m. at Police Headquarters, Inspector

Blaize gave me 4 envelopes sealed and marked:

(a) Swab of blood from Accused's left foot.

(b)Saide of blood from accused's left foot.

(c) Clotted blood from accused

(d) Unc/atted blood from accused.

I recognised the writing as being that of Dr. Thomas Ag. Chief Medical Officer.

I kept them in my custody and now produce them.-

At about 8.45 a.m. on 21/1/77, I went to St. Thomas with all the

exhibits that I have produced and handed them over to John Richards the

Director of Crime Laboratory in St. Thomas. He gave me a receipt. I kept

it in my custody, and now produce it. EXH. V.M. 21
