EXERCISE OF POWER TO REFUSE PERMISSION TO LAND

An immigration officer may refuse permission to land to

any person arriving, or deemed to be arriving in the Colony, (other than a person who has the right to land in Hong Kong under the provisions of section 8(1) of the Immigration Ordinance) if, in the opinion of the officer, the person arriving

(a) does not have adequate means of subsistence; or

(b) is unlikely, for any reason, to be capable of earning a

livelihood; or

is unable to show that he has the means to support himself and his dependants, if any, until he obtains employment; or is likely to become a vagrant, beggar or a charge upon any public or private charitable institution; or

(e)

is suffering from a contagious disease; or

(f)

is not in possession of a valid travel document or is in possession of a forged or altered travel document or a travel

document which does not fully comply with any legal requirement; or

has been removed from any country or state by the authorities of that country or state for any reason whatever; or

(h) is known or suspected to have been involved in or connected

with the illegal distribution of narcotics; or

is suspected of being likely to promote sedition or to disturb the public tranquility; or

is unable to show that he has definite employment awaiting him or that he has a reasonable prospect of obtaining employment

or that he is a person of independent means; or

is a prostitute, a person living on the earnings of prostitution

or a person of known immoral or criminal character; or

(k)

is not in possession of any certificate which may be required under quarantine regulations; or

(m)

is unable to show that he has a right to enter another country; or refuses to answer any lawful question put to him by an immigration officer or gives unsatisfactory answers or refuses to make and sign any prescribed form of declaration or enter into a recognizance if so required; or

is prohibited from entering the Colony under any law for the time being in force.
