FAILS
FUGITIVE LAWFULLY HELD
The Full Court, comprising the Chief Justice, Mr. J. B. Wood, and the Paiste Judge, Mr. R. E. Lindsell, yesterday refused the application "of Joseph E. Besa for a writ of "habeas corpus."
Besa is wanted by the Philippine authorities for robberies of which he was convicted Ave years ago. He faced extradition pro credings and was committed to prison for 15 days on May 16.

Mr. Fraser who appeared for the Crown said the questions the 'Court had to decide were whether the magistrate in the Court below had jurisdiction and whether there was evidence upon which he could com- mit. In his affidavit, Besa had challenged the power to extradite on a number of grounds. The first was that there was unreasonable de- lay in the proceedings before the magistrate. There was no delay. said Mr. Fraser, for the magistrate in his rotes, stated that the first intimation the Government of the Philippine Islands had of the fugitives arrival in the Colony was on March 23 of this year. A letter was received from the Governor of the Islands on April 8 and action was taken at once. The question whether the delay was unreasonable was a matter entirely for the magis trate.

The treaty had been held by the Imperial Government as applying to ail parts of His Majesty's dominions and had been applied to Hong Kong. It had also been ap: plied in the United States to the Philippine Islands by an act of the 36th Congress, 1903. Ruling as to Crown's Duty,
