To my mind much turns on whether Donald Leach is out or not. The last three wickets, unless the order has been alter ed are Divecha, Mansel-Smith, Coward, and Isaacs. But Leach may wall have held back his better batsmen and sent in two or three of these men to play out time. I do it is anyone's game. But it is no good' speculating now when doubt-

(2) That there must be evidence. d's will prove it with such cortainty as to justify a verdict of guilty. (3) The evidence must be such; as to be inconsistent witli accused's. innocenes of guilt. (4): It must not be a case of suspicion or ingenious. theories, but of evidence. (5) Tha evidence must be sufficient to ex- clude the reasonable possibility of someone else haying committed the crime. (6) It must be such evid- ence as will axolude the possibility of the "deed having been committed when the accused was engaged in the prosecution of some other. offence of a different character from murder, in which murder was not contemplated. (7) The evidence must exclude the possibility of the accused being present but of not taking part in the deed. (8) If any common purpose was alleged, it must be such as to exclude the possibility of such common pur pose being to kidnap only,

Dealing with the evidence as to rime of death, Mr. Fitzroy said that it had not been established be yond reasonable doubt that the man was dead before the prisoners were arrested. That was a reason why the case should not have gone to the jury There was not, the oor tainty in the evidence which was necessary in a case of murder.

After further submissions which had not closed Mr. Titaroy's argu ments," the Court adjourned until to-morrow morning.
