The stand for the seventh wicket
Put on sixty-seven runs, of which no far an can be made out Minu had seven only and Ar H. Madar and Extras the balance. I suspect a lot of extras as Patterson and Mr. Extras, got twenty-nine be- tween them if Minu's seven is gor rect. But then the good work con After
Linned. Burnett made twenty-nine, our bad half hour on
and Beck was not out with sixteen Sunday evening when wo lost thres
to his brodit, and a total of one of our best wickets for fifteen ruas hundred and eighty was roached- victory indeed seemed within the pe far beyond the most sanguine grasp of Shanghai. And when Ehopos of Hong Kong's partisans
F. Fincher, Mitchell and Hamilton all fall yesterday morning for the. dddition of only thirty-one runs it deemed hil over bar she shouting. But thon A. H. Madar stepped in and played a most gallant innings while the Hong Kong tail wagged In a frantie fashion. At the time the liner Aro written-about 8' p.m. only base details are to hand, though I trust the outline scoro published below this article will be fully implemented in the Stop Proy

Shanghal Orash.
Whether it was the fnot that the wicket has cut up badly in tho fourth innings, or whether it was that they got their tails down in fien of a most unexpected recovery and a heavy three hours or more in the fold we do not yet know. Probably it was a bit of bath. But Shanghai by the close of play have lost seven wickets for eighty-two. A. R. Minu is doing the damage us he has taken four for twenty-

To-day's Play
Z
The game will be resumed at 12.15 p.m. to-day, and Shanghai have their last three wickets left to get seventy-seven runs, The odds are on Hong Kong but the match is by no means over. To my mind much turns on whether Donald Leach is out or not. The last three wickets, unless the order has been alter ed are Divecha, Mansel-Smith, Coward, and Isaacs. But Leach may wall have held back his better batsmen and sent in two or three of these men to play out time. I do it is anyone's game. But it is no good' speculating now when doubt-

Chan and Cheung Sau Fu were charged with the murder of a youth named Tsang Tai Kai. The jury return-duced three home runs, all the for od a verdict of guilty against all the Athletics, though they won by three prisoners Sentence on the were Simmons, Cochrane and Foxx. Cleveland
4- only. The successful battors Washington Bocond and third prisoners, defend- od by Mr. Somerset Fitzroy, was "deferred by" Mr. Justice Wood when Counsel applied for the poiab to bo roserved as to whether the case should have been loft to the jury.
Arguing first on points of law before the Full Court, Mr. Fitzroy said that if a party of men went out to commit a futony and one of ihem did, something clar, such as n murder, which was outside the common design, then only the per. son who caused the death could be guilty of murder. I was patent that such had happened in the enge under considération.
Essential Polats.
Mr. Fitzroy submitted that the "following points were 'necessary in order for the case to be left to the jury(1) There must be evidence which proves beyond reasonabio doubt the guilt of the accused. (2) That there must be evidence. d's will prove it with such cortainty as to justify a verdict of guilty. (3) The evidence must be such; as to be inconsistent witli accused's. innocenes of guilt. (4): It must not be a case of suspicion or ingenious. theories, but of evidence. (5) Tha evidence must be sufficient to ex- clude the reasonable possibility of someone else haying committed the crime. (6) It must be such evid- ence as will axolude the possibility of the "deed having been committed when the accused was engaged in the prosecution of some other. offence of a different character from murder, in which murder was not contemplated. (7) The evidence must exclude the possibility of the accused being present but of not taking part in the deed. (8) If any common purpose was alleged, it must be such as to exclude the possibility of such common pur pose being to kidnap only,
Dealing with the evidence as to rime of death, Mr. Fitzroy said that it had not been established be yond reasonable doubt that the man was dead before the prisoners were arrested. That was a reason why the case should not have gone to the jury There was not, the oor tainty in the evidence which was necessary in a case of murder.
After further submissions which had not closed Mr. Titaroy's argu ments," the Court adjourned until to-morrow morning.
