Appeal against Tenancy Tribunal decision
The question as to whether or not the so-called landlord of 141/143 Waterloo Road, Kow- loon, was in law entitled to possession within the meaning of section 19 (1) of the Land- lord and Tenant Ordinance was argued yos- terday.
This was done before the Appeal Court during an appeal against a Tenancy Tribunal decision which held that Mrs. Marion Ramsey was not so entitled to the premises.
Lecture on plastics
The scientific background of the thousand and one plastic gadgets which are in dully_use today will be explained by Pro- fessor J. E. Driver. Professor of Chemistry nt the University of Hong Kong, by a short lecture preceding a film on the subject in the British Council Library next Wednesday.
Mrs. Ramsey is represented by Mr. C. Lozeby, KC, in structed by Deacons. The res- pondent in the appeal is Mrs. M. A. de Menezes. Mr. B. A. Bernacchi on the instructions of Mr. J. M. d'Almada Re- medios, is appearing for Mrs. Menezes,
Mr. Justice Scholes, Acting Pulsne Judge, to trying the case.
In opening his case, Mr. Loseby told the Court that the appeal was against the judgment of Mr. W. H. Latimer, Tenancy Tribunal President, on an interesting point or law. Arguments put for- ward by Mr. Remedios at the Another im dealing with Ap-hearing below were successful.

NOTICE

Referring to the definition of the word "landlord" as contained in another part of the Ordinance, counsel pointed out that the land- lord is a person who is entitled to receive rent in respect of premises from time to time.
Mr. Loseby went on to say that Mrs. Ramsey, hla client, has been receiving rent for the past 25 years. Going briefly into the appellant's history in this connection, counsel sald she was the daughter of ene Willam Lysaught, who died in 1010, leaving land property at 131/133 Wanchal Road,
Loft in trust-
The land was lett in trust. The terms and conditions of the trust to the trustees were that
they pay the whole of the out-
come of the property to the ap- pellant during her Hetime.
In 1924, the appellant sold the property and bought 141/143 Waterloo Road, 'She hersel! moved into No. 143; and rented No. 141 for six years after. Coun sel asked the Court to imply that her, action at the time must have had the knowledge and consent
of the trustees.
Mrs. Ramsey went to Sa Francisco in 1990, and returned here In September, 1949. The rent, in the meantime, had been collected on her behalf by Dea- cons.
Mr. Loseby referred once more word to the definition of the "landlord"," and submitted that. whichever way one looks at it, she was the landlord of the house within the meaning of the section concerned of the Landlord and Tenant Ordinance.
Mr. Bernacchl, In the course of his reply, quoted numerous legal authorities to support lis contentions that though the ap- pellant was undoubtedly the landlord of the premises by de- finition, she was not a landlord within the meaning of the section. She was thus not entitled to an order for possession of the house in her capaelly, he argued,
After further legal submissions, hearing was adjourned until June 15 at 10 a.m.
