talks has been one of the main reasons for the Premier, General Abe's decision to remain in office.

It is believed that the New Year holidays, which tra- ditionally extend until the second week in Jan- uary, will be used for consolidating the position of the Cabinet in order to enable it to resume talks with America and achieve some results when the Diet re-opens on January 21, five days before the expiration of the 1911 Treaty.

Meanwhile, Mr. Suma, spokesman of the Japanese Foreign Office, stated that several interviews between the American Ambassador, Mr. Grew, and the Foreign Minister, Admiral Nomura, are likely before this date. Mr. Suma stated that the preliminary parleys aimed at the establishment merely of a "modus vivendi" between Japan and the United States. Such modus viven- di would not necessitate approval from Congress before being enforced.

Mr. Suma cited three precedents this year, namely, the modus vi- vendi algned by President Roose- velt with Germany, Italy and Russia, without

previous agreement of Congress.

Mr. Suma further stated the opinion that it would be possible by such mo- dus vivendi not only to prolong the previous treaty for one year, for in- stance, but also to add new articles to the text of the old treaty.

He concluded that the Japanese decision partially to re-open the Yangtse must not be interpretad as a basla for any bargaining with the United States, but the decision was freely taken by Tokyo.

"We will do what we said, whatever the-fate-of-the-trade treaty--may-be," he concluded.-Havas.
