UNSATISFACTORY EVIDENCE.
In the Admiinity Division, MA Justice Batéon, sitting with Trinity House Masters, had before him an action brought by the owners of the schooner John Chson. for damages hgainst the owners of the steamer Empresa, French Cross Channe" steamship in connection with a collision which occurred, on January 1, 1926, o short distance from Dover Piet. The plaintiffs' case was that the niling Vessel was heading S.. without any steering way, with the

evidence before him of the weather aftor the collision. It was a very extraordinary thing if the weather was foggy that the Empress should. go on again at a high speed. It was also strange that a man who was supposed to have blown the whistle for the Empress was not called.
Defendants had admitted that they were grossly negligent on their own case, and that they were partly to blame, He was satisfied that the defendants' story was morely put forward as an excuse for fall. ing to see the John Gibsop sconer than they did. He was going to find their case was an' exaggerated: one. There would be judgment for plaintiffs.
