Otherwise the associations and bodies interested in the matter, to whom no such communication has been made, will complain of the special treatment accorded to the West India Committee.

Downing Street, October 9, 1907. WITH reference to my Circular despatch of the 2nd of July,§ I have the the information of your Ministers, the accom- honour to transmit to you, for

your information, panying copies of a Report by Sir Henry Bergne, K.C.B., K.C.M.G., of the Proceedings of the Permanent International Sugar Commission at its recent meeting, which was held to consider the proposals of His Majesty's Government with regard to the Brussels Sugar Convention.

2. Those proposals were accepted by the Commission; the Additional Act to the Brussels Sugar Convention which was agreed to by the Commission for giving effect to them has since received the approval of His Majesty's Government and of the Governments of the other contracting States; and the Additional Act, together with an accompanying Declaration, copies of which are enclosed, has been signed by the Diplomatic Representatives of the contracting States at Brussels, subject to subsequent ratification on the part of the signatory Powers who are full parties to the Convention.

3. With regard to this Act it is to be observed that, although under the new arrangement the United Kingdom, in accordance with the principle upon which His Majesty's Government felt bound to insist, will be dispensed from the obligation to prohibit or countervail bounty-fed sugar, such dispensation will not probably affect the trade of the British Colonies, since-the only bounty-giving country which exports sugar to any appreciable extent is Russia, and the total amount of suck sugar is small compared with the total sugar production of the world, while it is further contemplated that Russia may become a party to the Convention, on which subject the Russian Government has submitted proposals for the consideration of the Governments of the contracting States.

4. On the other hand it will be seen that under the Additional Act the Convention is to be renewed for a further term of five years from the 1st of →→ September, 1908 (instead of being continued merely from year to year under Article X of the Convention), subject only to its possible discontinuance at the

ACTE ADDITIONNEL A LA CONVENTION DU 5 MARS 1902 RELATIVE in No. 19 in

Les Gouvernements de l'Allemagne, de l'Autriche et de la Hongrie, de la 1907] Belgique, de la France, de la Grande-Bretagne, de l'Italie, du Grand-Duché de Luxembourg, des Pays-Bas, du Pérou, de la Suède et de la Suisse s'étant mis d'accord pour conclure un acte additionnel à la Convention du 5 mars 1902, relative au régime des sucres, les soussignés, à ce dûment autorisés, sont convenus de ce qui suit :

Article premier.

Les Etats contractants s'engagent à maintenir la Convention du 5 mars 1902 en vigueur pendant une nouvelle durée de cinq ans, qui prendra cours le 1er Septembre 1908.

Toutefois, il sera loisible à chacun d'entre eux de se retirer de la Convention à partir du 1er septembre 1911 moyennant préavis d'un an, si, dans la dernière réunion tenue avant le 1er septembre 1910, la Commission permanente a, par un vote de majorité, décidé que les circonstances commandent de laisser cette faculté aux Etats contractants.

Pour le surplus les dispositions de l'article 10 de la Convention précitée du 5 mars 1902 concernant la dénonciation et la tacite reconduction resteront applicables.

Article 2.

Par dérogation à l'article premier, la Grande-Bretagne sera dispensée, à partir du 1er septembre 1908, de l'obligation inscrite à l'article 4 de la Convention.

A partir de la même date, les Etats contractants pourront exiger que, pour jouir du bénéfice de la Convention, le sucre raffiné dans le Royaume-Uni et exporté vers leurs territoires soit accompagné d'un certificate constatant qu'aucune partie de ce sucre ne provient d'un pays reconnu par la Commission permanente comme accordant des primes à la production ou à l'exportation du sucre.

Article 3.

Le présent acte additionnel sera ratifié et les ratifications en séront déposées 'à Bruxelles, au Ministère des Affaires étrangères, le plus tôt possible et en tous cas

avant le 1er février 1908.

Il ne deviendra obligatoire de plein droit que s'il est ratifié au moins par tous ceux des Etats contractants, qui ne sont pas visés par la disposition exceptionnelle de l'article 6 de la Convention. Dans le cas où un ou plusiers desdits Etats n'auraient pas déposé leurs ratifications en temps utile, le Gouvernement helge provoquera, dans le mois à partir du 1er février 1908, de la part des Etats ayant ratifié, une décision, quant à la mise en vigueur, entre eux seulement, du présent acte additionnel.

Les Etats qui nauraient pas ratifié avant l'échéance du 1er février 1908 serunt considérés comme ayant dénoncé la C'onvention en temps utile pour qu'elle cesse ses effets à leur égard à partir du 1er septembre suivant, à moins de décision contraire prise, à la requête des intéressés, par la majorité des Etats appelés à délibérer ainsi qu'il est prévu au paragraphe précédent.
