(e) by adding after subsection (2) the following new subsection—

“(ZA) Notwithstanding, subsection (2), the court may, in relation to a person convicted of an offence under this sec- tion, exercise the powers conferred by section 45 of the Mental Health Ordinance and for the purposes of that section an offence undor this section is for the "avoidance of doubt declared not to be an offence for which the sentence is fixed by law.".
