COUNCIL CHAMBER,
14th September. 1954-
Explanatory Note.
(This Node is not part of the Order but is intended to indicate ite general purport).
In section 3 it is provided that the Landlord and Tenant Ordinance shall not apply to "any entirely new building in respect of which the written permit of the Building Authority to occupy the same shall have been granted under the provisions of section 137 of the Buildings Ordinance, after the 18th day of August, 1945". Since section 137 of the Buildings Ordinance does not apply to the New Territories new buildings there are not excluded. It is considered that the intention of the Landlord and Tenant Ordinance was to exclude from its application all new buildings. This Order therefore places new buildings in the New Territories on the same foating as new buildings elsewhere in the Calony.
